When making a purchase, you agree to these terms.
Please read these Terms and Conditions (“Terms,” “Terms and Conditions”) carefully before purchasing your Free Spirit Marketplace. When making purchases, you agree to be bound by these Terms.
Communications
By purchasing from Free Spirit Marketplace, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link at the bottom of any email we send.
Purchases
If you wish to purchase any product through Free Spirit Designs, you may be asked to supply certain information relevant to your purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.
Free Spirit Designs may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product availability, possible errors in the description, price of the product, or for any other error in your order.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Shipping is included in the price with every purchase.
Free Spirit Designs is currently only shipping to the US Contiguous 48 states. We currently do not ship to Hawaii and Alaska. We do not ship to P.O. Box addresses.
Returns
If you are not completely satisfied with your purchase, please contact us at marketplace@freespiritdesigns.biz to return or exchange your item(s) within 30 days of the delivery date, with proof of purchase. Note that returns or exchanges are not accepted on items that have been installed and are no longer in their original packaging.
Upon return, your item will be inspected and exchanges, credits or refunds will be issued for the purchase price. Free Spirit Designs reserves the right to refuse returns or exchanges of items that are not in as-new condition due to damage or misuse by the client. There is a 30% restocking fee applied to any items that are being returned not due to damage caused during shipping.
Cancellations
For all orders that are canceled prior to items shipping, a full refund will be given to the customer.
Should you decide to cancel a return and keep the item after a refund was issued, we will charge your credit card in the amount of the refund issued.
Availability, Errors, and Inaccuracies
We are always reviewing and updating our website for inaccuracies. We reserve the right to make changes to our website without prior notification.
Content
Content found on or through Free Spirit Designs’ website, social media, and exclusive Facebook groups are the property of Free Spirit Designs. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.
Intellectual Property
Free Spirit Designs and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Free Spirit Designs. Our name and the tagline “Living Beyond Ordinary” may not be used in connection with any product or service without the prior written consent of Free Spirit Designs.
Fraud Protection
As part of our order processing procedures, we may screen received orders for fraud or other types of unauthorized or illegal activity. We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If we suspect fraudulent, unauthorized, or illegal activity, we may reject your order or we may contact you at the phone number or email address you provided to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorized or illegal activity. We take these measures to protect our customers as well as ourselves from fraud or other unauthorized or illegal activity.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Florida, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding Free Spirit Designs, and supersede and replace any prior agreements we might have had between us regarding Free Spirit Designs.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
